OpenHoods Launch Special — Free Listing Terms & Conditions

1. The Offer
Open Hoods Australia, trading as OpenHoods ("OpenHoods", "we", "us") is offering a limited promotional offer ("Launch Special") to celebrate the launch of our platform in Australia. Under this offer, eligible sellers may list their vehicle on openhoods.com.au at no cost, subject to the terms below.
2. Eligibility
To be eligible for the Launch Special, you must:
- Be a resident of Australia aged 18 years or older.
- Create a registered account on openhoods.com.au.
- List a vehicle that you legally own or are authorised to sell.
- Disclose your current demerit points to prospective buyers as part of the listing process. This is a mandatory requirement of all OpenHoods listings, both free and paid.
3. Offer Limits
- The Launch Special is limited to the first 500 listings published on OpenHoods across all users. This is a collective cap, not a per-user limit.
- Each user may create a maximum of 2 (two) free listings under this promotion.
- Once 500 total free listings have been claimed across the platform, the Launch Special will end and standard pricing of $55 AUD per listing will apply.
- OpenHoods reserves the right to end, modify, or extend this promotion at any time without prior notice.
4. Listing Duration
Listings remain published until the vehicle is sold or the seller removes the listing. This applies to both free Launch Special listings and standard paid listings.
5. Listing Requirements
All listings, whether free or paid, must comply with the following:
- Listings must be for genuine vehicles currently available for sale.
- All information provided must be accurate and not misleading.
- Sellers must provide real photos of the actual vehicle being sold (no stock images).
- Sellers must disclose their demerit points to buyers upon request or at the point of inspection.
- Listings must not contain offensive, discriminatory, or illegal content.
6. Demerit Point Disclosure
OpenHoods is built on the principle that responsible drivers are generally more responsible vehicle owners. As a condition of listing on OpenHoods (both free and paid):
- Sellers agree to share their current demerit point status with prospective buyers.
- Demerit points can be verified by buyers through their state or territory's official demerit point checking service.
- OpenHoods does not independently verify demerit point claims. Buyers are encouraged to verify directly through official government channels.
- OpenHoods is not affiliated with or endorsed by any government agency.
7. Removal of Listings
OpenHoods reserves the right to remove any listing that:
- Contains false or misleading information.
- Does not represent a genuine vehicle for sale.
- Violates these terms or our general Terms of Use.
- Is reported by other users for legitimate concerns.
8. No Cash Value
- The Launch Special has no cash value and is not transferable.
- The free listing cannot be exchanged for credit, refund, or any other form of compensation.
9. Standard Pricing
- Once the Launch Special has ended or a user has exceeded their 2 free listing limit, the standard listing fee of $55 AUD applies per listing.
- For reference, comparable platforms charge significantly more: listings on other major Australian car marketplaces can range from $79 to $324 or more per listing.
10. Privacy
- Your personal information will be handled in accordance with our Privacy Policy.
- Your demerit point information is shared directly between seller and buyer — OpenHoods does not store or publish your demerit point records.
11. Limitation of Liability
- OpenHoods provides a platform for private vehicle sales and does not participate in, guarantee, or take responsibility for any transaction between buyers and sellers.
- OpenHoods makes no warranty regarding the accuracy of any listing information, including demerit point disclosures.
- Use of the platform is at your own risk.
12. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the jurisdiction of the courts of New South Wales.
